The Workers’ Rights Act 2019 (Act No. 20 of 2019), which came into force on 24 October 2019, is the primary employment statute in Mauritius, replacing the Employment Rights Act 2008 and the Employment Relations Act 2008 as the main source of individual employment law. It is administered by the Ministry of Labour, Human Resource Development and Training, and establishes the mandatory framework for employment contracts, working hours, annual leave, sick leave, maternity and paternity leave, notice periods, the Portable Retirement Gratuity Fund, the 13th-month bonus, and wrongful termination proceedings before the Industrial Court. Every employment relationship in Mauritius must comply with the Workers’ Rights Act 2019 from the first day of employment.
